Terms of Service

1. Agreement to Terms

By accessing or using the Carrier Recruit Chrome extension and website (collectively, the "Service"), operated by Carrier Recruit ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Carrier Recruit is a Chrome browser extension that extracts publicly available carrier registration data from the Federal Motor Carrier Safety Administration (FMCSA) website. The Service allows users to view, filter, and export this data for use in their dispatch and carrier recruitment operations.

The Service is offered in the following subscription tiers:

• Basic ($9/month): Access to daily FMCSA registration data extraction, filtering by carrier type, CSV export, and limited monthly extractions.
• Pro ($19/month): All Basic features plus access to up to 20 years of historical carrier data, increased monthly extractions, priority support, and early access to new features.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payment

The Service is offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

• Payments are processed through Stripe. Your payment information is handled directly by Stripe and is not stored on our servers.
• Subscription fees are billed in advance on a monthly basis and are non-refundable except as required by applicable law.
• We reserve the right to change subscription pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No partial refunds are issued for unused portions of a billing cycle.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in violation of any applicable federal, state, or local law or regulation.
• Redistribute, resell, or sublicense the Service or data obtained through the Service without our prior written consent.
• Attempt to reverse-engineer, decompile, or disassemble the extension or any part of the Service.
• Use automated scripts or bots to interact with the Service beyond the extension's intended functionality.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the data obtained through the Service for any purpose that violates the Telephone Consumer Protection Act (TCPA) or any other applicable telecommunications regulation.

7. Data and Content

The data extracted by the Service originates from the FMCSA, a publicly accessible government database. We do not guarantee the accuracy, completeness, or timeliness of this data. You are solely responsible for verifying the accuracy of any data before relying on it for business decisions.

We do not claim ownership of the publicly available data extracted through the Service. However, the Service itself, including its code, design, and proprietary features, remains the intellectual property of Carrier Recruit.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Carrier Recruit and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAVIK SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Carrier Recruit, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
